A gambling complaint involving Malta needs a defined recipient and purpose. Start with the operator's complaints procedure. An unresolved disagreement about a transaction may belong with the operator's named alternative dispute resolution provider; a report about possible regulatory misconduct serves a different function at the Malta Gaming Authority.
This guide explains that routing distinction using official MGA material and European Alternative Dispute Resolution (EADR) rules checked on 26 October 2026. It does not assess an individual claim, recommend a provider or promise payment. The operator, product, account contract and provider's remit must fit the case.
Establish which business and licence cover the account
Record the exact website and the legal entity named in the account terms. Check the relevant regulator record and save the complaints policy that applies to that account. A familiar brand, a group company's Maltese address or a supplier's licence is insufficient to select a consumer dispute route.
The Malta B2C and B2B licence guide explains why the company offering gambling to customers must be distinguished from its software suppliers. Our licence-verification workflow shows how to connect an entity with the domain and permitted activity. Neither article substitutes for the current account contract or register.
Once the entity is clear, use its internal procedure. The MGA's current player-protection guidance says operators need a documented complaints process in their terms, with the relevant ADR details. It describes referral after the internal process has been exhausted. Keep the original complaint and the operator's reasoned response, including any instructions for escalation.
Separate a transaction dispute from a regulatory report
The MGA explained the division in its 3 December 2018 ADR announcement. From 1 April 2019, its Player Support Unit would not decide the merits of disputes between players and B2C licensees. Relevant ADR entities would perform that function. The unit would still examine complaints about potentially unlawful, unsafe, unfair or non-transparent provision of gaming services as compliance matters.
These tasks can arise from the same account. An adjudicator may need to decide whether a particular deduction followed the contract, while the regulator considers whether the handling indicates a licence-compliance problem. Reporting the second issue does not establish the outcome of the first.
| What needs an answer? | Starting route | What to establish before escalation |
|---|---|---|
| Was a particular win, withdrawal or deduction handled correctly? | Operator procedure, then its relevant ADR route if unresolved | Contracting entity, disputed transaction, final response and provider remit |
| Does conduct suggest a regulatory breach? | Relevant MGA complaint channel, within its stated scope | Licensee, website, conduct, dates and supporting evidence |
| Does one incident raise both questions? | Distinguish the individual dispute from the regulatory concern | State which outcome each recipient is being asked to consider |
This is an editorial routing aid, not an acceptance decision. Do not infer that every Maltese business or every gambling website is within MGA jurisdiction. For a mixed case, disclose existing proceedings and ask the intended recipient how they affect admissibility.
Check the named ADR provider rather than choosing one at random
The MGA ADR Directive, version 2 of July 2025, requires the relevant gambling competence and permits operators to use more than one ADR entity. The operator should refer the player to the entity appropriate to the dispute. The engaged route must be free to the player.
EADR is a useful example of why the provider's own rules matter. Its published procedure uses English or German and says the process is free to consumers. It can refuse cases where reasonable attempts at resolution with the operator have not been exhausted, where the matter has already been considered by another ADR body or court, or where submission falls outside its stated twelve-month window measured from the complaint to the operator. Other refusal grounds also apply.
Those are EADR's terms, not a universal Maltese filing period. Naming EADR here does not establish that it serves the casino in your case or will accept your dispute. Obtain the operator's actual referral and check it against the provider's current intake requirements before sending personal records.
Ask what kind of outcome the process can produce
The July 2025 directive says arbitration or adjudication conclusions bind the operator and player, subject to its Article 10 exception. For disputes outside the competence of Malta's Small Claims Tribunal, a licensee may offer non-binding ADR, including mediation. It must explain that choice, its consequences and the route to a binding decision.
The practical question is therefore more precise than "Is ADR binding?" Ask which procedure is offered for this dispute, what the operator's ADR policy says, and what accepting a proposed resolution would mean. Obtain qualified advice before accepting terms that may affect further legal action. This guide does not determine tribunal jurisdiction, monetary limits or the enforceability of a particular outcome.
Keep procedural clocks separate too. EADR describes a 90-calendar-day process after receipt of all documentation, with an extension possible in exceptionally complex cases following notice. That does not run automatically from the first support message, and it is not a promised date for a bank credit. The British eight-week operator process described in our Great Britain ADR guide should not be imported into a Maltese complaint.
Prepare the referral without creating a second dispute
Suppose a fictional casino account contains a disputed game deduction and the operator has rejected the customer's explanation. Before escalation, identify the specific entry and clause, the remaining disagreement and the outcome requested. Ask the operator to identify the appropriate ADR provider and confirm that its internal process is complete.
If the same correspondence suggests a regulatory concern, describe that conduct separately. A request to correct an account balance and a report that the procedure is not transparent ask different questions. Do not submit the same merits dispute to several adjudicators in the hope that one accepts it; a provider's rules may exclude a matter considered elsewhere.
Keep the referral pack focused:
- The legal operator, exact domain and account reference relevant to the complaint.
- The disputed transaction, applicable terms and a concise statement of the remedy sought.
- The complaint as sent, acknowledgement, material replies and internal final position.
- A dated evidence index and any existing ADR or court case that must be disclosed.
The transaction-history evidence guide supplies a separate chronology format. Use verified channels and proportionate records; do not send passwords, login codes or wallet recovery phrases. No real complaint, account or intake submission was tested for this article.
The MGA's current complaint page states that its formal channel concerns MGA-licensed operators, accepts English or Maltese and strongly recommends approaching the operator first. Its existence should not be read as a promise that the regulator will adjudicate a payment entitlement. The recent MGA/MCCAA cooperation announcement likewise did not establish a replacement portal or guaranteed refund.
Frequently asked questions
Can the MGA decide whether my casino must pay me?
Do not assume that submitting its complaint form obtains an individual payment award. The MGA distinguishes compliance complaints from disputes on their merits, which it assigns to the relevant ADR entity. Identify the licensee, complete the operator's procedure and establish which recipient can examine the particular outcome you seek.
Is EADR the provider for every MGA-licensed casino?
No such conclusion follows from its rules or this guide. Use the provider named in the operator's applicable complaints procedure and confirm its remit. Operators can engage different entities for different matters. A published ADR website explains a service; it does not prove an agreement with every licensed operator.
Should I use an old link to the EU ODR platform?
Do not rely on it as the current submission route. The July 2025 MGA directive marks its ODR provision repealed, effective 20 July 2025, in connection with discontinuation of the European platform. Follow the operator's current ADR referral and the named provider's intake instructions rather than an old footer link.
Before sending a case, be able to name the operator, the issue, the recipient and the requested decision. A correct referral does not guarantee success, but it prevents an account dispute from being confused with a regulator's compliance investigation.
